Herewith we would like to inform you about how we process personal data of applicants. “Personal data” means all information regarding to an identified or identifiable natural person, e.g. name or contact details. The natural person (also referred to as “data subject” in data protection law) means the applicant in connection with this data protection notice.
Who we are
“We“, “us” or “our” means Allgeier SE, Einsteinstr. 12, 81677 Munich, Germany, +49 89 99 84 21 0, info@allgeier.com, and at the same time the person responsible for data processing within the meaning of data protection law. If you agree that we may pass on your application documents within Allgeier Group, this also applies to our group companies, which can be found at https://www.allgeier.com/en/who-we-are/divisions/. In this case, we act as “jointly responsible persons” together with our group companies. We are primarily responsible for the data protection information duties and any rights of data subjects (see “Your rights”). Our data protection officer is therefore at your disposal as the central point of contact for any questions you may have regarding data protection. You can reach him at the following contact details: SECUWING GmbH & Co. KG, Mr. Maximilian Hartung, Frauentorstraße 9, 86152 Augsburg, +49 821 90786458, epost@datenschutz-agentur.de. However, you can also contact each individual responsible at any time.
Which personal data we process
We primarily process the personal data that we receive directly from you. For example, the data that you send to us as part of an application process or upload via our applicant page. These are primarily your contact details, CV details, certificates, references if applicable. If your application comes to us via a recruiter or at your request from another third party, we receive at least part of the information from these third parties. In addition, we may, to the extent permitted by law, verify any information you provide as part of the application process through publicly available sources or, with your consent, contact references or obtain criminal records. If you do not already know the external source, we will inform you within a reasonable period, but at the latest within one month, unless a statutory exception to the obligation to inform applies.
For which purposes we process the data
We process the above-mentioned data for the purposes of carrying out the application procedure, which may include checking the correctness of your data in individual cases. If your application is successful, we also process your data in order to set up the employment relationship. In addition, you can decide whether we should retain your details for future job offers and/or share them with other potential employers within our group of companies. This is also done for the purposes of conducting an application process. Furthermore, personal data may be further processed if this is necessary for the purposes of asserting, exercising or defending legal claims.
Legal basis of the processing
The legal basis for the processing of your data is primarily Art. 6 para. 1 lit. b DS-GVO or § 26 BDSG, which permit the processing of personal data for fulfilling a contract or for implementing pre-contractual measures at the request of the person concerned. Some processing operations are legitimised by Art. 6 para. 1 lit. f DS-GVO, i. e. they are necessary to safeguard the legitimate interests of the data controller or a third party. This includes processing which is necessary for the assertion, exercise or defence of legal claims by us. If we are legally obliged (e. g. for tax reasons) or entitled to a processing, a legal basis can also result directly from this law.
Recipients of personal data
We do not share your applicant data with third parties unless you have consented to it or this is necessary to comply with a legal obligation or for the assertion, exercise or defence of legal claims. As part of the administration and handling of our application process, we have sometimes engaged service providers (e. g. the company hosting our website). We have bound them to us with contracts for processing data, i. e. they process personal data exclusively on our behalf and on our instructions.
Transfer to a third country
A transfer of personal data to a country outside the European Union (EU) or the European Economic Area (EEA) is only permitted if the country has a data protection level recognised by the EU Commission or otherwise suitable guarantees are provided or a legal exception applies for certain cases (Art. 49 DS-GVO). Your applicant data will only be transferred to a so-called third country if the potential employer within Allgeier Group is established in such a third country or if this applies to one of our contract processors. In both cases, we ensure that either the recipient country has an adequate level of data protection recognised by the EU Commission or that appropriate safeguards, such as standard data protection clauses, have been agreed to.
Storage period
We retain your personal data for the duration of the application process or for the duration specified in your consent. Any original documents will be returned to you after completion of the application process for our approval. In addition, we delete/destroy your personal data, unless further storage is necessary for the purposes of asserting, exercising or defending legal claims or due to a legal obligation (e. g. tax or commercial retention obligations).
Your rights
According to the data protection regulations, you may be entitled to the following rights depending on the circumstances:
§ Right to information on correction or deletion of personal data, rights to limitation of processing.
§ Right to data transmission.
§ Right to object: If the processing of your personal data is based on the legitimate interest of the data controller (Art. 6 para. 1 lit. f DS-GVO) or for the performance of a task which is in the public interest or is carried out in the exercise of official authority assigned to the data controller (Art. 6 para. 1 lit. e DS-GVO), you have the right to object to the processing for reasons relating to your particular situation.
§ If the processing of your personal data is based on your consent, you have the right to revoke your consent at any time, without this impairing the legality of the processing due to your consent prior to its revocation.
§ You also have the right to file a complaint with a supervisory authority.
§ Automated decision-making does not take place.
If you have any questions or concerns regarding the processing of your personal data, please contact our data protection officer. You can also exercise your rights by sending an e-mail to bewerbung@allgeier.com.
